These Terms of Service ("Terms") govern your use of the PreMax mobile application ("PreMax", the "app"). By downloading or using PreMax, you agree to these Terms. If you do not agree, please do not use the app.
PreMax photographs or looks up a food and scores it as pre-workout fuel for the workout type and timing you select. It returns a tier, a session forecast, a crash-risk estimate, and a suggested fueling window. PreMax creates an anonymous session for you on first launch; there is no account, email, or password.
PreMax is a fitness and nutrition information tool. Its scores and forecasts are estimates for general informational and educational purposes only. They are not medical, nutritional, or professional advice, and they are not a substitute for guidance from a qualified physician, dietitian, or trainer. Nutrition data is sourced from third parties and may be incomplete or inaccurate. Do not rely on PreMax to diagnose, treat, or prevent any condition. Consult a qualified professional before making decisions about your diet, supplements (including caffeine), or training, especially if you have a medical condition, are pregnant or nursing, or are sensitive to stimulants. You use PreMax at your own risk.
PreMax includes a limited number of free scans. Continued access to scanning requires a PreMax Pro subscription, offered as auto-renewable subscriptions:
Prices are shown in the app at the point of purchase in your local currency and may vary by region. Purchases are processed by Apple through your App Store account. Payment is charged to your App Store account at confirmation of purchase. If a free trial is offered and you do not cancel at least 24 hours before the trial ends, your subscription begins and your account is charged.
Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price for the applicable plan. Any unused portion of a free trial is forfeited when you purchase a subscription.
You can manage or cancel your subscription, and turn off auto-renewal, in your device's App Store account settings after purchase. Deleting the app does not cancel your subscription. Except where required by law, payments are non-refundable; refund requests are handled by Apple under the App Store terms.
We grant you a personal, non-transferable, non-exclusive license to use PreMax for your own non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions. You agree not to copy, modify, reverse engineer, resell, or misuse the app, and not to upload content you do not have the right to use or that is unlawful.
You are responsible for the photos and search queries you submit. By submitting a food photo, you grant us permission to process it for the purpose of recognizing the food and returning its score, as described in our Privacy Policy. We do not store your photos on our servers after analysis.
PreMax relies on third-party services, including Supabase, OpenAI, the USDA FoodData Central API, Superwall, and Apple. Your use of features powered by these services may be subject to their terms, and we are not responsible for their availability or content.
PreMax is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of results. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or harm arising from your use of, or reliance on, the app or its scores.
We may update these Terms from time to time. We will notify you of significant changes through the app. Continued use of PreMax after changes constitutes acceptance of the updated Terms.
